Compliance with Federal Law and Mailing Regulations

For the purpose of this section, "hemp" is defined in accordance with federal law, specifically as provided under Section 10113 of the Agricultural Improvement Act of 2018, Pub. L.115-334 (7 U.S.C. § 1639o), or any successor provision.
Mailing Requirements for Hemp-based Products
Hemp and hemp-based products, including cannabidiol (CBD) with a tetrahydrocannabinol (THC) concentration not exceeding 0.3 percent, are permitted to be mailed within domestic mail only under the following conditions:
Compliance with Applicable Laws and USDA-Approved Plans: The mailer must comply with all applicable federal, state, and local laws, as well as plans approved by the United States Department of Agriculture (USDA) under 7 CFR Part 990, which pertain to hemp production, processing, distribution, and sales.
Retention of Records: The mailer is required to retain records that establish compliance with the aforementioned laws and USDA-approved plans. These records may include laboratory test results, licenses, or compliance reports. It is mandatory to maintain these records for a minimum of three years from the date of mailing.
